Music Submission Agreement
Basically, by submitting your material, you are giving all rights and ownership to Sean Fournier. You do not collect royalties for any sales. Sean Fournier must give you credit whenever and wherever your work is used.
These music submission terms and conditions (this “Agreement”) describe the legal relationship between “you” (the “Submitter”), (an individual artist, or, in the case where you are involved with a band, an individual acting as the legal representative of your band) with Sean Fournier.
By submitting any material or information to Sean Fournier, you explicitly confirm that you have read, understood, and agreed to the following Agreement:
If you provide Sean Fournier with sound recordings, musical works and/or other material (such as pictures, videos, song lyrics, etc.; collectively “Standard Program Material”) the following terms apply:
Grant of License:
You hereby grant to Sean Fournier, and by the act of delivering Standard Program Material to Sean Fournier grant to Sean Fournier, a nonexclusive, worldwide, royalty-free license to: (a) reproduce, distribute, publicly perform, publicly display and digitally perform the Standard Program Material in whole or in part (including the right to create compilations which include your recordings); (b) create and use samples of the Standard Program Material solely for the purpose of demonstrating or promoting our or your products or services; (c) use any trademarks, service marks or trade names incorporated in the Standard Program Material in connection with your material; and (d) use the name and likeness of any individuals represented in the Standard Program Material only in connection with your material.
Indemnification:
The Submitter agrees to defend, indemnify, and hold Sean Fournier harmless from any and all claims, costs, damages, judgments, and liabilities (including but not limited to reasonable attorney’s fees) made by any third party and arising from any content the Submitter posts, submits, transmits or otherwise makes available through Sean-Fournier.com, the Submitter’s violation of the terms and conditions of the Music Submission Agreement, or the violation of the intellectual property rights of any third party.
Right to Refuse Content:
Sean Fournier reserves the right not to accept Standard Program Material at any time and for any reason, in its sole discretion.
Modification of Agreement:
Sean Fournier may modify this Agreement in its sole discretion. When such modification is made, Sean Fournier will post a revised version of this Agreement on the Site. Modifications to this Agreement will be effective when they are posted. Sean Fournier is not required to provide you with notification that any such modification has been made. It is your responsibility to review this Agreement as posted on the Site from time to time to be aware of any such modifications.
